Class Action Lawsuit Updates

ABITIBI/ABTCO SIDING CLASS ACTION
Class members have 25 years, from the original installation date, to file a claim. Claimants are eligible to file an additional claim 12 months from the date your first claim form was complete.

Please contact the Customer Support office at 1-800-549-4465 to find out when you are eligible. You are eligible to file a total of six claims over the 25-Year Warranty period.
CLADWOOD SIDING CLASS ACTION
The original settlement term expired in 2002, but was extended. The extended settlement has been successfully concluded and no more claims are being accepted. Class members who submitted claims after the settlement fund was exhausted have been notified that their claims will not be paid under the settlement.
GEORGIA PACIFIC SIDING CLASS ACTION
For the people who have Georgia Pacific Jarratt or Catawba hardboard siding on their homes, the deadline for filing a claim was August 18, 1998.

At this time no further claims are being accepted.  Georgia Pacific is still honoring the 20 year warranty on their products.
LOUISIANA PACIFIC SIDING CLASS ACTION
The class action was open to anybody with this siding on their homes that was installed prior to 1/1/96 and that siding is damaged or becomes damaged prior to 1/1/2003, and did not "opt out" during the "opt out" period. You can no longer file a claim with the L-P Settlement Administrators at 1-800-245-2722.

This class action was initiated in 1996 and was on going through the year 2002. It is over now. The siding is currently under its original 25 year warranty. If you have damage and need to file a warranty claim call 1-877-677-6722 to get the warranty claim form.
MASONITE X-90 SIDING CLASS ACTION
The settlement provides a seven (7) year and a ten (10) year claims program.

If you own Masonite Hardboard Siding installed and incorporated into a home or other structure between January 1, 1980 and December 31, 1989, you had to file your claim(s) under the Seven Year Program by January 15, 2005. If you own Masonite Hardboard Siding installed and incorporated into a home or other structure between January 1, 1990 and January 15, 1998, you have ten years, until January 15, 2008 within which to file your claim(s). Once the settlement expires, the remainder of Masonite's warranty, if any, will remain in effect. You may be entitled to receive compensation for siding that fails under the terms of Masonite's warranty program separate and apart from this settlement.
MASONITE OMNIWOOD SIDING CLASS ACTION
The settlement provides a ten (10) year claims program, subject to two provisions. The first would allow defendants to void the settlement after seven years; the second would permit defendants to extend the agreement for an additional ten (10) years.

If the settlement extends for the first ten years, you must file your claim(s) by January 6, 2009. If the defendants exercise the early termination option, claims must be filed by January 6, 2006. If defendants exercise the option to extend the agreement an additional ten years, the settlement will terminate January 6, 2019. Once the settlement expires, the remainder of Masonite's warranty, if any, will remain in effect. You may be entitled to receive compensation for siding that fails under the terms of Masonite's warranty program separate and apart from this settlement.
POLYBUTYLENE PLUMBING PIPING COX V. SHELL OIL CLASS ACTION
Yard service line (Big Blue) which connects your house to the street water main and was installed between January 1, 1978 and July 31, 1995 had 10 years, from the original installation date, to file a claim. The claim period is now over.

CA 6

Homes with interior polybutylene water piping installed between January 1, 1978 and July 31, 1995 with acetal insert fittings the leak must occur within 13 years from the date of installation. The claim must be filed within 14 years after the date of installation.

CA 7

Homes with interior polybutylene water piping installed between January 1, 1978 and July 31, 1995 with metal insert fittings the leaks must occur within 16 years from the date of installation or before 1-31-09, whichever is earlier. The claim must be filed within 17 years after the date of installation or before 5-1-09, whichever is earlier.
